I came accross a detective from cib and a forensic person while doing a run today. I asked if they could link the two incidents together, it seems they have no evidence to do so and i dont see how they could prove it. Anyhow they were taking photos and measurements, so theyre doing theyre job, collecting evidence, and will hopefully lay more charges once they have all the evidence, we just need to wait and see what happens. All in all, its already a win for us because the trails are now safer.

As you say Tom, it could be that he set up the same wire Chilli ran into...

However given the number of places that we see these traps... blockages... rocks.. etc, it's pretty unlikely it is just the one person doing it.

EG: Piles of nails semi dug into the ground on a trail a good few kms away.
I got a flat on a South Hobart trail closer to the bottom of the Mountain, stopped to patch it up and noticed dozens of them all tossed in amongst semi dug up dirt. Sat there for 20 minutes trying to pick them all out of the ground so it wouldn't happen to someone else.

Don't know if any one had heard of the indecent, but I remember a few years ago, a wire was strung across a motorbike track at St.Helens, 2 people came around the corner, one riding, one on the back, the rider sore the line and ducked, the person on the back wasn't so lucky. Its understandable what happened if you put two and two together. But this just shows what can easily happen as the speeds gained on these tracks are easily the speeds gained on a motorbike on a flat track.

Charging him with creating a common nuisance, seems to be a slap on wrist to what he should be charged with in my eyes.
Needs a Bike!!!

I just hope the charges are severe enough to act as a deterent for others setting traps. This case will set the precedent for later cases if there is any; which there will be if people only get a slap on the wrist unless they kill someone.

yea December 6th is when the court hearing is. We need like 3 4 or so people to go to the court hearing and try and plea for a harsher sentence the more people the better.

I have a feeling they've gone for the "Creating Common Nuisance" charge rather than an attempted murder or the like, due to the fact that they are far more likely to get a conviction agains this idiot. If they try for a harsher sentance, likelyhood is that he walks free...

I'm all for throwing the book at this guy - but I'd rather he gets a criminal conviction, than walks free from a harsher charge. With a criminal conviction, this guy won't be able to travel, it'll come up on any jobs he applies for, it'll even come up when he applies for home/car loans etc... While the actual charge may not seem that intense, the ramifications for the rest of his life are - so i'm fairly satisfied the police are doing the right thing.

Agreed.

Was chatting to a cop on the weekend and mentioned this case. He replied that the "Public Nuisance" charge is actually quite serious, despite how it sounds, with scope for a severe sentence.

Also asked about the setting of "man traps" which is contained within the Tasmanian criminal code (keyword search 'man trap' http://www.thelaw.tas.gov.au). It's an old act. I may have misheard him, but I suspect more contemporary legislation is given preference in court proceedings.

From my limited understanding, attempted murder would only be applicable to a trap intended for a specific person or group of persons; I'd imagine "mountain bikers at large" as somewhat outside that scope thus they are using the most applicable contemporary legislation.
